1. Agreement
Draft: These Terms are subject to legal review and may change before final publication.
These Terms and Conditions (“Terms”) are a contract between you and GigZA (Pty) Ltd (registration number 2026/673329/07). By using the GigZA platform (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
GigZA is a digital marketplace that connects Clients who need services with Hustlers who provide them. GigZA is not an employment agency and does not employ Hustlers.
Business location: Kraaifontein, Cape Town, 7570, South Africa
2. Definitions
- Client — a user who posts gigs seeking services
- Hustler — a user who applies for and performs gigs
- User — any person using the Service
- Gig — a posted service request
- Application — a Hustler’s response to a Gig
- GigZA Credit — non-withdrawable platform wallet credit that may offset platform fees (also referred to as GigZA Cash in earlier versions)
3. Eligibility
You must be 18 or older, a resident of South Africa, and able to enter a binding contract. You must provide accurate registration information and keep your login credentials secure.
4. Using the Service
4.1 Permitted use
You may use GigZA to post gigs, apply for gigs, communicate through approved channels, and build a reputation through ratings.
4.2 Prohibited conduct
You may not post false or fraudulent content, harass others, break the law, circumvent payments or platform fees, share private contact details in public gig listings before hire, discriminate unlawfully, scrape or automate access without permission, or impersonate others.
4.3 Content
All content must be accurate, lawful, and respectful of others’ rights.
5. Gigs, pricing, and estimates
- Clients post gigs at a fixed cash price in ZAR. The Client pays the posted price at checkout unless we show a different minimum in the app (currently R150 minimum gig value).
- Duration estimates (e.g. “1–2 hours”) are guidelines only, not wage rates or guarantees.
- Hustlers see a personalised “Earn R…” amount on open gigs before applying. Earn amounts depend on your account and are shown in the app; they are not shown on public share links in the same personalised form.
- Posting gigs is currently free; we may introduce posting fees with advance notice.
Clients are responsible for accurate gig descriptions and a safe environment. Hustlers are responsible for skills, punctuality, and their own tools and transport unless agreed otherwise.
If scope changes materially, Client and Hustler should agree any price change before extra work. GigZA is not obliged to adjust escrow for off-platform agreements.
6. Payments and platform fees
- Payments are processed through licensed partners, including TradeSafe escrow (Instant EFT / Ozow where enabled) and/or card flows (e.g. Paystack) as shown in the app.
- Funds are held in escrow or pre-authorised until both parties mark the gig complete, then captured and disbursed according to the payment flow shown at hire.
- The Client is not charged a separate platform fee at checkout on top of the posted gig price.
- GigZA retains a platform fee from the Hustler’s side of the transaction. Fee treatment, GigZA Credit, and your take-home amount are disclosed in the app when you view or accept a gig—not in these public Terms.
- Payment processing and escrow costs are absorbed by GigZA from its platform revenue where configured—not added to the Client’s checkout total.
- Cancellations more than 2 hours before a scheduled start generally release holds without charge, subject to partner rules.
Payouts: Hustlers receive payouts to a linked South African bank account on our partners’ settlement schedules (as shown in the app). Optional faster cash-out, if offered, may incur a fee disclosed before you confirm. GigZA Credit offsets platform fees only and is not withdrawable cash.
Disputes: parties should try to resolve issues within 24 hours; thereafter GigZA Operations may assist. GigZA’s determination on platform payment disputes is final where permitted by law.
7. Ratings and reviews
Users may rate each other after completion. Reviews must be honest and relevant. We may remove reviews that violate policies. Ratings affect visibility and tier progress but are not a warranty of work quality by GigZA.
8. Verification and safety
Hustlers may submit ID and a selfie for verification. We may use manual review and/or configured verification partners. Verified users may receive a badge. GigZA does not conduct full background checks; users interact at their own risk. Report concerns via the app.
9. Relationship between users
Hustlers are independent contractors, not employees of GigZA or Clients. They are responsible for their own tax, insurance, and compliance.
The service relationship is between Client and Hustler. GigZA facilitates matching and payments. To the extent permitted by law (including the Consumer Protection Act), GigZA is not liable for property damage, injury, or work quality arising from gigs. Nothing here excludes liability that cannot be excluded under South African law.
10. WhatsApp and external messaging
After hire, GigZA may facilitate WhatsApp contact. You consent to gig-related messages on channels you use. Conduct on external platforms must remain professional; we cannot monitor all off-platform chat.
11. Intellectual property
GigZA owns platform branding, software, and design. You retain ownership of content you post but grant GigZA a licence to use it to operate the Service.
12. Limitation of liability
The Service is provided “as is” to the extent permitted by law. GigZA’s total liability for claims relating to the Service is limited to fees you paid to GigZA in the 12 months before the claim, except where the law does not allow such limitation.
13. Indemnity
You agree to indemnify GigZA against claims arising from your use of the Service, your content, your violation of these Terms, or services you provide or receive through the platform.
14. Consumer Protection Act
These Terms are subject to the Consumer Protection Act, 2008. If any term conflicts with the CPA, the CPA prevails for consumers.
15. Termination
You may close your account in settings. We may suspend or terminate accounts for violations, fraud, repeated reports, safety risks, or legal requirements. Outstanding payment obligations survive termination.
16. Disputes and law
Parties should attempt informal resolution first. These Terms are governed by the laws of South Africa. Courts in South Africa have jurisdiction unless mandatory law provides otherwise.
17. Changes
We may update these Terms. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
